Nearly every contract relating to the business of selling or licensing art, or providing creative services, necessarily involves federal Copyright law. It is crucial that artists and creative service providers have a firm understanding of agreements that govern their work. Many artists and creative service providers get into legal trouble due to working without proper contracts. Minimizing legal risk and avoiding customer conflicts are easier once you understand these types of contracts. This workshop will focus on both understanding contract terms in typical art business contracts as well as creating your own personalized, plain-English agreements. A well-crafted, “user friendly” agreement will protect the legal interests of artists, while at the same time assist in setting a professional tone at the start of the artists working relationship. Contracts to be discussed will include: Artwork consignment agreements, creative collaboration deals, model releases, agent agreements, and licensing and commission contracts.
Christene is a partner at Boyne Clark. Her practice focuses on business, entertainment and intellectual property law. She is a founding member of Women in Film and Television – Atlantic, a member of the Canadian Intellectual Property Office’s Speakers Bureau, an Associate of the Law & Technology Institute, an Affiliate of the Intellectual Property Institute of Canada, Past Chair of the Canadian Bar Association’s National Intellectual Property subsection, and a former lecturer at Dalhousie University Law School.
The Nova Scotia Artists Legal Information Society (ALIS) is an upcoming organization, aiming to provide local artists and writers with legal resources and legal consultation. Providing free legal information, workshops, and library resources to struggling artists and writers, the organization’s goal is to help artists, actors, musicians, dancers, writers, and filmmakers understand their legal problems and to provide a framework for navigating these obstacles.
